Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of the LingoEval website and services (the “Service”) operated by LingoEval (“we”, “us”). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

LingoEval provides online practice for DELF and DALF French exams, including reading, listening, writing, and speaking activities with AI-assisted feedback. The Service is intended for exam preparation and self-assessment only.

LingoEval is not an official exam, certification body, or diploma. We are not affiliated with France Éducation international or any official exam center. Scores and feedback on the platform do not constitute official exam results.

We may add, modify, or remove practice activities from production at any time, at our discretion. We may pull an activity out of production (make it unavailable to start) only if you have not yet started that activity—that is, you have no attempt or progress on it. If you have already started an activity, you retain access to complete it and view your results.

3. Accounts

You must provide accurate and complete registration information and keep your account details up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

Each account is for personal use by a single individual. You may not share your account or credentials with others.

4. Free and Pro access

You may browse activities and start practice sessions without a paid subscription. With a free account you may submit one reading activity for AI scoring (or one writing activity at C2, when available). Further scored submits, listening and writing at other levels, and speaking audio submission and analysis require an active Pro subscription. You can always view results for attempts you have already submitted.

We may change which features are available on free versus Pro plans. Current feature availability is described on the website and in your account settings.

5. Subscription and billing

Pro subscriptions are billed in advance on a monthly recurring basis through Stripe, our payment processor. Prices may be shown in USD or BRL depending on your selected currency.

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can manage or cancel your subscription at any time through the Stripe Customer Portal linked from your account settings.

By subscribing, you authorize us and Stripe to charge your payment method for recurring fees until you cancel. Failed payments may result in suspension of Pro features.

6. Usage limits

Pro subscribers are subject to monthly usage limits per billing period. The billing period follows your Stripe subscription period when available; otherwise, limits reset on the first day of each UTC calendar month.

• Reading, listening, and writing: a shared pool of up to 100 attempts with status “evaluating” or “done” combined across these three activity types per billing period.
• Speaking: up to 20 attempts with status “evaluating” or “done” per billing period, counted separately from the shared pool above.

Only one attempt per activity type may be in “evaluating” status at a time. Attempts beyond these limits cannot be submitted until the next billing period or until existing attempts are completed.

7. Fair use

You agree to use the Service in good faith and in accordance with these Terms. You may not abuse, automate, scrape, or overload the platform; share accounts; resell access; or attempt to circumvent usage limits or security measures.

We may suspend or restrict access if we reasonably believe your use violates these Terms or harms the Service or other users.

8. Your content

You retain ownership of text, answers, audio, and other materials you submit through the Service (“Your Content”). By submitting Your Content, you grant us a limited license to store, process, and analyze it solely to operate the Service, provide AI-assisted feedback, and improve quality and security.

You represent that Your Content is yours to submit and does not violate any law or third party rights. Do not submit unlawful, harmful, abusive, or infringing material.

9. AI feedback disclaimer

AI-generated scores, corrections, and comments are provided for practice and learning purposes only. They may contain errors and do not replace professional instruction or official exam grading.

We do not guarantee any particular exam outcome or performance level based on use of the Service.

10. Intellectual property

The LingoEval name, branding, website design, software, and original activity content are owned by us or our licensors and protected by applicable intellectual property laws. These Terms do not grant you any right to use our trademarks or content except as needed to use the Service as intended.

11. Third-party services

The Service relies on third-party providers, including Stripe for payments, Supabase for authentication, and AI and cloud infrastructure partners. Your use of those services may be subject to their terms and policies. See our Privacy Policy for how we handle data shared with these providers.

12. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

13. Refunds

Refunds are governed by our Refund Policy. In summary, first-time subscribers may request a full refund within 7 days of their initial purchase, subject to the conditions described in that policy. Renewal charges are generally non-refundable.

14. Suspension and termination

We may suspend or terminate your access to the Service if you breach these Terms, engage in abuse or fraud, or if required by law. You may cancel your subscription at any time through the Stripe Customer Portal; cancellation stops future billing but does not automatically delete your account.

15. Disclaimers

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim related to the Service is limited to the amount you paid us in the twelve months before the claim.

LingoEval is not affiliated with France Éducation international, the CIEP, or any official DELF/DALF examination authority or test center.

16. Changes

We may update these Terms from time to time. We will post the revised version on this page and update the “Last updated” date. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
